What happened

The Landlord applied to terminate the tenancy because the Tenant breached a condition of a previous LTB order by failing to pay rent on time in September 2025. An eviction order was subsequently issued without a hearing. The Tenant filed a motion to set aside this eviction order, claiming e-transfer issues and banking closures over a holiday weekend prevented timely payment. The Board examined the Tenant's testimony against email evidence and past payment history.

The ruling

The Tenant's motion to set aside the eviction order (LTB-L-073375-25) is denied. The Board found the Tenant breached the conditions of a prior order and that her explanations for the breach were inconsistent and unsupported by evidence. The stay of the eviction order is lifted effective October 31, 2025, allowing the Landlord to proceed with eviction.
