What happened

The Tenant filed T2 (substantial interference) and T6 (maintenance) applications, alleging the Landlord failed to adequately address a persistent bed bug infestation. The Tenant claimed the Landlord's treatments were ineffective. The Landlord argued they responded reasonably to all complaints and that the Tenant's lack of cooperation hindered the extermination process.

The ruling

The Tenant's applications for maintenance failure and substantial interference due to a bed bug infestation are dismissed. The Board found the Tenant's evidence regarding complaints in 2023 to be unreliable. For 2024, the Landlord's response was deemed reasonable, and the continued presence of pests was linked to the Tenant's non-compliance with treatment protocols. The Tenant's refusal to permit further treatment absolved the Landlord of further action at that time.
