What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant substantially interfering with the Landlord's reasonable enjoyment or lawful right, privilege or interest, and the Tenant wilfully or negligently causing undue damage to the rental unit. The application was based on a N5 notice served on the Tenant on September 24, 2022 for a flood incident on August 13, 2022 that caused damage to the bathroom floor and furnace.
The ruling
The Tenant is ordered to pay the Landlord $4,763.49 for the damages caused by the flood by May 31, 2024. If the Tenant fails to comply with the conditions, the Landlord may apply to terminate the tenancy. The Tenant is also ordered to notify the Landlord immediately of any maintenance issues in the rental unit.
