What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord intends to convert the rental unit to a non-residential use. The Landlord served a N13 notice to terminate the tenancy effective December 31, 2020 pursuant to section 50 of the Residential Tenancies Act because the Landlord was in contravention of the City building by-laws.

The ruling

The tenancy is terminated effective August 31, 2021. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction starting September 1, 2021.
