What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The tenancy is terminated effective December 31, 2023. If the unit is not vacated by that date, the landlords may file the order with the Court Enforcement Office for enforcement. If the tenants vacate by December 31, 2023, the landlords will waive the $22,600 in rent arrears. If the tenants do not vacate, they will be responsible for the arrears plus interest.
