What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
The ruling
The tenancy is terminated without voiding provisions on July 1, 2023. The tenants must move out by that date. The tenants owe the landlord $11,438.67, which includes rent arrears up to March 31, 2023 and the application filing fee. The tenants must pay $150 per month starting April 1, 2023 until the arrears are paid off. They must also pay new rent on time and in full until July 1, 2023. If the unit is not vacated by July 1, 2023, the tenants must pay daily compensation of $47.32. If the tenants fail to make any payments, the full amount becomes due and will bear interest.
