What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Landlord also claimed NSF cheque charges and related administration charges.

The ruling

The Landlord's application for eviction of the Tenant is denied on the condition that: 1) The Tenant shall pay $900.00 to the Landlord on or before the 1st of each month commencing on December 1, 2021, up to and including March 1, 2023; 2) The Tenant shall pay $299.20 to the Landlord on or before April 1, 2023; and 3) The Tenant shall also pay the Landlord the rent for the months of December 2021 up to and including April 2023 in full, on or before the first day of each corresponding month. If the Tenant fails to make any of the payments in accordance with these conditions, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and for the payment of any new arrears of rent and NSF charges not already ordered.
