What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.

The ruling

The tenancy will be terminated on October 31, 2023 unless the tenant pays the outstanding rent arrears of $17,886 by September 18, 2023, $20,836 by October 18, 2023, or $23,786 by October 31, 2023. If the tenant does not make the required payment, the tenancy will be terminated and the tenant must vacate the unit by October 31, 2023. The tenant will owe the landlord $12,904.78, which includes rent arrears and the application filing fee, minus the rent deposit and interest.
