What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to substantial interference with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. The Landlord claimed the rental unit was in an extremely cluttered and unsanitary condition, posing fire, health and safety risks.

The ruling

The tenancy is terminated effective October 18, 2021. The Tenants must move out of the rental unit on or before October 18, 2021. The Tenants shall pay the Landlord $35.64 per day for compensation for the use of the unit from October 8, 2021 to the date they move out, as well as $186.00 for the cost of filing the application. If the Tenants do not pay the full amount owing by October 18, 2021, they will start to owe simple interest at 2.00% annually on the outstanding balance.
