What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord served a valid N8 notice on the Tenant, which detailed 10 late rent payments made by the Tenant during the 12-month period from November 1, 2020 to October 31, 2021. The Landlord also provided evidence of additional late payments up to October 31, 2022.

The ruling

The tenancy will continue, but the Tenant must pay the full lawful monthly rent on or before the 1st of each month for a 12-month period from December 1, 2022 to November 1, 2023. If the Tenant fails to comply, the Landlord may apply to terminate the tenancy without notice. The Tenant must also pay the $186 application filing fee.
