What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant has not paid the total rent the Tenant was required to pay for the period from August 1, 2019 to September 30, 2020. The Landlord served a Notice of Termination effective November 27, 2019 due to the arrears. The Tenant vacated the rental unit on July 15, 2020 and is now in palliative care.
The ruling
The tenancy between the Landlord and the Tenant terminated on July 15, 2020. The Tenant shall pay the Landlord $5,797.87, which represents the amount of rent owing and compensation up to July 15, 2020. The Tenant shall also pay the Landlord $190.00 for the cost of filing the application. If the Tenant does not pay the full amount owing by October 16, 2020, the Tenant will start to owe interest at 2.00% annually on the outstanding balance.
