What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant owed $5,723.00 in rent arrears for the period from January 1, 2020 to September 30, 2021. Landlord served a Notice of Termination effective August 13, 2022. Tenant did not attend the hearing.

The ruling

The Landlord's application for eviction is denied on the condition that the Tenant follows a payment plan. The Tenant must pay $400.00 monthly from February 1, 2022 to October 1, 2022, with a final payment of $381.00 on November 1, 2022. The Tenant must also pay regular monthly rent on time. If the Tenant fails to make any payments as scheduled, the Landlord may apply for eviction within 30 days of the breach.
