What happened
The Landlord applied for an order to determine whether the Residential Tenancies Act, 2006 applies to the Tenant's accommodation. The Landlord argued that the Tenant's accommodation is exempt under section 5(a) of the Act as it is intended for the travelling or vacationing public or occupied for a seasonal or temporary period in a motel.
The ruling
The Residential Tenancies Act, 2006 does not apply to the Tenant's accommodation at the Landlord's motel, as it is exempt under section 5(a) of the Act.
