What happened
Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent and damage to the rental unit and residential complex. The Landlord served a valid N4 notice for non-payment of rent and an N5 notice for damage and substantial interference.
The ruling
The tenancy is terminated effective October 29, 2021. The Tenant must pay the Landlord $7,589.15 for rent arrears, compensation, and NSF cheque charges, less the rent deposit and interest. The Tenant must also pay $4,385 for damage to the rental unit and residential complex, and $24.36 per day in compensation for continued occupation after October 18, 2021. If the Tenant does not vacate by October 29, 2021 and pay the full amount owing, the Landlord may file the order with the Sheriff for enforcement.
