What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.

The ruling

The tenancy is terminated effective October 31, 2020. The tenants must pay $2,312.47 to the landlord, which includes rent arrears up to October 20, 2020 and the application filing fee. The tenants must also pay $39.48 per day for compensation for use of the unit from October 21, 2020 until they vacate. If the full amount is not paid by October 31, 2020, the landlord may file the order with the Sheriff for enforcement.
