What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective April 1, 2024. The tenants must vacate the rental unit by that date. The tenants owe the landlord $12,668.40, which includes rent arrears up to March 31, 2024, and the cost of filing the application, minus the rent deposit, interest on the deposit, and credits for a deposit return and rent abatement. The tenants must also pay the landlord $115.07 per day for use of the unit starting April 2, 2024 until they move out.
