What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.
The ruling
The tenant shall pay the landlord $5,466 for rent arrears and costs in accordance with a repayment plan, with the first payment of $1,940 due by June 27, 2022, the second payment of $1,770 due by July 27, 2022, and the final payment of $1,756 due by August 31, 2022. The tenant shall also pay new rent on time and in full as it comes due until the arrears are paid in full. If the tenant fails to make any one of the payments, the outstanding balance shall become immediately due and owing, and the landlord may apply to the LTB for an order terminating the tenancy and evicting the tenant.
