What happened

The Landlord applied for an order to increase the rent above the guideline due to capital expenditures. The Tenants AW, JW, and JR disputed the quality of the asphalt work, while the Landlord's witness DC testified that the work was necessary and adequate. The Landlord also proved that the heat reflector and toilet upgrade projects were eligible capital expenditures.

The ruling

The Landlord may increase the rents charged by the percentage increases and within the time periods set out in Schedule 3. The Landlord or the Tenants shall pay to the other any sum of money that is owed as a result of this order within 90 days.
