What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's failure to meet a condition specified in the mediated settlement issued by the Board on July 31, 2019 with respect to a previous application. The Tenant filed a motion to set aside the order issued on May 20, 2021.

The ruling

The Tenant's motion to set aside the previous order was denied. The Tenant was found to have breached the conditions of the mediated agreement, and it would be unfair to the Landlord and other tenants to grant the Tenant's motion.
