What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser requires possession of the rental unit for the purpose of residential occupation.

The ruling

The tenancy is terminated effective January 15, 2022. The Tenant must move out by that date. The Tenant shall pay the Landlord $847.24 for use of the unit from November 1, 2021 to December 21, 2021, less the rent deposit and interest owed on the deposit. The Tenant shall also pay the Landlord $43.33 per day for use of the unit from December 22, 2021 until the Tenant moves out. If the Tenant does not pay the full amount by January 1, 2022, the Tenant will owe interest at 2% annually on the outstanding balance.
