What happened
Landlord applied to terminate the tenancy and evict the Tenant due to the Tenant or a guest causing undue damage to the rental unit by careless smoking and improper disposal of cigarette butts, substantially interfering with the Landlord's reasonable enjoyment, and seriously impairing the safety of others.
The ruling
The tenancy is terminated effective November 3, 2021. The Tenant must vacate the rental unit by November 14, 2021. The Tenant is ordered to pay the Landlord $5,000 for the repair costs and $186 for the application filing fee. If the Tenant does not pay the full amount by November 14, 2021, they will owe interest starting November 15, 2021. If the unit is not vacated by November 14, 2021, the Landlord may file the order with the Court Enforcement Office for enforcement.
