What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant sought adjournment, which was denied. Tenant claimed to have withheld rent due to safety issues but did not properly notify the Landlord. Tenant requested relief from eviction, proposing a payment plan.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying the full amount owing. The Tenant is given until March 31, 2023, to vacate the unit if payment is not made. The Tenant must pay $10,686.00 by February 28, 2023, or $11,436.00 by March 31, 2023, to void the eviction order. If the tenancy is terminated, the Tenant must pay $8,485.32 plus $24.66 per day from February 3, 2023, until move-out.
