What happened
Landlord applied for an order to terminate the tenancy of Tenant Gladys Soloway and for compensation for the use of the rental unit and NSF cheque charges and related administration charges. The Tenant became ill and required hospitalization, and during her absence, a former guest of the Tenant allowed additional occupants to move in and essentially take over the rental unit. The Tenant felt uncomfortable with these individuals and felt unable to return to the rental unit.
The ruling
The tenancy between the Landlord and the Tenant is terminated effective August 31, 2020. The Unauthorized Occupant shall move out of the rental unit on or before August 31, 2020 and pay the Landlord $190.00 for the cost of filing the application. If the Unauthorized Occupant does not pay the full amount owing by August 31, 2020, interest will be owed at 2.00% on the outstanding balance starting September 1, 2020. If the unit is not vacated by August 31, 2020, the Landlord may file the order with the Court Enforcement Office (Sheriff) for expedited enforcement.
