What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
The ruling
The tenancy is terminated effective January 5, 2021. The Tenant shall pay the Landlord $7,737.57, which represents the rent owing to December 11, 2020 and the Landlord's filing fee, less the rent deposit and interest owing on the deposit. The Tenant shall also pay the Landlord $27.19 per day in compensation for the use of the unit from December 12, 2020 to the date the Tenant vacates. The order will be void if the Tenant pays $9,117.94 on or before December 31, 2020 or $9,945.05 on or before January 5, 2021.
