What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The former Tenant Celeste Payette had vacated the rental unit on September 9, 2021, prior to the hearing date.

The ruling

The tenancy is terminated effective March 31, 2022. The Tenant must pay the Landlord $16,814.96, which includes rent arrears up to January 26, 2022, less the rent deposit and interest on the deposit. The Tenant must also pay $56.40 per day for compensation for use of the unit starting January 27, 2022 until the Tenant moves out. If the Tenant does not pay the full amount by March 31, 2022, the Tenant will owe interest starting April 1, 2022.
