What happened

Landlord applied for an order requiring Tenant to pay rent owed. Tenant never physically occupied the unit due to COVID-19 and suspension of in-class learning at McMaster University. Landlord refused early termination but offered alternatives. Tenant attempted to sublet/assign but was unsuccessful. Board previously ruled Landlord's restrictions on subletting/assigning were reasonable.

The ruling

The Board ordered the Tenant to pay the Landlord $4,500.00 for rent arrears from July 1, 2020 to April 30, 2021, less the rent deposit, plus $201.00 for the application filing fee. The total amount owed is $4,701.00. If not paid by February 19, 2022, interest will accrue at 2.00% annually from February 20, 2022.
