What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, and the Tenants remained in possession on the hearing date.

The ruling

The tenancy is terminated effective February 26, 2023 due to rent arrears and persistent late payment of rent. The Tenants must pay $18,628.24 to void the order for arrears or $13,646.41 to the Landlord if they do not void the order. The Tenants must also pay daily compensation of $62.76 for each day of occupation after January 13, 2023. If the unit is not vacated by February 26, 2023, the Landlord may file the order with the Sheriff for enforcement.
