What happened
Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit on September 4, 2020, prior to the hearing date.
The ruling
The Tenant vacated the rental unit on September 4, 2020. The Tenant shall pay the Landlords $5,345.30, which represents the rent arrears and compensation up to September 4, 2020, less the rent deposit and interest owed on the deposit. The Tenant shall also pay $190.00 for the application filing cost. If the full amount is not paid by February 22, 2021, the Tenant will owe simple interest at 2% annually on the outstanding balance.
