What happened

Landlord applied to terminate the tenancy and evict the Tenants due to non-payment of rent and substantial interference with the reasonable enjoyment of the residential complex. The Landlord served a valid N4 Notice for non-payment of rent and an N5 Notice for substantial interference. The Tenants did not attend the hearing.

The ruling

The tenancy is terminated effective November 15, 2021. The Tenants must pay the Landlord $10,266.50, which includes rent arrears up to November 4, 2021 and the cost of filing the application, minus the rent deposit and interest on the deposit. The Tenants must also pay $52.60 per day for compensation for use of the unit starting November 5, 2021 until they move out. If the Tenants do not pay the full amount by November 15, 2021, the Landlord can file the order with the Sheriff to enforce the eviction.
