What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.

The ruling

The tenancy will be terminated on March 31, 2023 unless the Tenants pay the outstanding amount by that date. The Tenants can void the order and continue the tenancy by paying $1,499.09 by January 31, 2023, $2,806.60 by February 28, 2023, or $4,114.11 by March 31, 2023. The Landlord owes the Tenants $958.03 for the rent deposit and interest, but the Landlord can deduct $42.99 per day for compensation for the Tenants' continued occupation of the unit.
