What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and overcrowding. The N4 notice for non-payment of rent was served, and the Tenant did not void the notice by paying the arrears. The Landlord also filed an L2 application for overcrowding, but withdrew it at the hearing as the issue was rectified.

The ruling

The tenancy is terminated unless the Tenant pays $7,476 by November 20, 2022 to void the order. If the Tenant does not pay, they must vacate the unit by November 20, 2022 and pay $6,728.60 in rent arrears and application fees, plus $25.97 per day in compensation for continued occupancy after November 3, 2022.
