What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. The N4 Notice was found to be defective, so the Landlord proceeded with the application seeking an order for arrears only. The Tenants attempted to raise maintenance issues under section 82 but were not allowed due to lack of proper notice to the Landlord.
The ruling
The Tenant is ordered to pay the Landlord $35,000, which includes rent arrears owing to January 19, 2023, and costs. If the Tenants do not pay the full amount by August 1, 2023, they will start to owe interest at 5.00% annually on the outstanding balance.
