What happened

Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith (T5 Application). The Tenants vacated the rental unit after receiving an N12 notice from the Landlord stating that she required possession of the rental unit for her own residential occupancy.

The ruling

The T5 application is dismissed. The Tenants have not established that the Landlord failed to move into the rental unit within a reasonable time after the Tenants vacated.
