What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant seriously impairing the safety of others in the residential complex by throwing heavy objects off his balcony onto the driveway below.

The ruling

The tenancy is terminated effective April 2, 2023. The Tenant must move out by that date. The Landlord is entitled to reimbursement of the $201 application fee. The Landlord owes the Tenant $1,708.69 for the rent deposit and interest, but the Landlord can deduct $63.02 per day for compensation for the Tenant's use of the unit starting March 9, 2023 until the Tenant moves out.
