What happened

Landlord applied for an order to terminate the tenancy and evict the Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. At the hearing, the Landlord's Representative requested consent of the Board to withdraw the application as the Landlord no longer seeking possession of the rental unit.

The ruling

The Landlord's application is withdrawn and dismissed. The Tenants are required to return the compensation paid by the Landlord or pay back the funds if the cheque has been negotiated. If the Tenants do not pay the Landlord the amount owing by January 31, 2022, they will start to owe interest at 2.00% annually on the balance outstanding.
