What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice). However, the evidence showed that one of the Tenants, Hannah Thompson, had vacated the unit in late 2019 and was no longer in possession of the rental unit when the application was filed.

The ruling

The original order is amended to remove Hannah Thompson as a Tenant, as she had vacated the unit prior to the Landlord filing the application.
