What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective February 15, 2021 unless the Tenants pay $4,482.04 to the Landlord or to the Board in trust by that date, in which case the eviction order will be void. If the Tenants do not make this payment, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The Tenants must also pay the Landlord $1,483.86 for rent arrears and compensation, less the rent deposit and interest owed on the deposit. The Tenants must also pay $45.95 per day for compensation for use of the unit starting February 5, 2021 until they move out.
