What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit on September 20, 2020, prior to the hearing date.

The ruling

The tenancy is terminated as of April 30, 2021 on consent of the parties. The Tenant must pay the Landlord $11,978.21, which includes rent arrears, compensation for use of the unit, and the application fee, less the rent deposit and interest. If the Tenant does not pay the full amount by October 30, 2021, they will owe interest. The Landlord may file the order with the Sheriff for enforcement if the unit is not vacated by April 30, 2021.
