What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The Landlord's application for eviction of the Tenants is denied on the condition that: (a) The Tenants pay the Landlord $243.75 on the 20th of every month for 4 months starting July 20, 2021 and ending on October 20, 2021; (b) The Tenants pay the Landlord the rent for the months of August 2021 to November 2021 in full and on or before the first of each corresponding month; and (c) The Tenants pay the Landlord $186.00 on November 1, 2021. If the Tenants fail to make any of the payments in accordance with the order, the Landlord may apply for an order terminating the tenancy and evicting the Tenants, and for the payment of any new arrears of rent and NSF charges.
