What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.

The ruling

The tenancy will be terminated on February 25, 2023 unless the Tenants pay $5,501.91 to void the order and continue the tenancy. If the Tenants do not pay, they must move out by February 25, 2023 and pay the Landlord $1,210.81 plus daily compensation of $66.44 per day starting January 27, 2023. If the Tenants void the L1 order, the tenancy will continue on the condition that the Tenants pay rent on time from March 2023 to February 2024.
