What happened

Tenant applied for an order determining that Landlords failed to meet maintenance obligations or comply with standards, and gave a notice of termination in bad faith. Landlord served N12 notice claiming their son and parent would occupy the unit, but Tenant later found the unit re-rented to a new tenant at a higher rent.

The ruling

The Landlord gave a notice of termination in bad faith. The Tenant is awarded $10,800 for the increased rent paid for 12 months, and $1,500 for moving expenses, for a total of $12,350 owed by the Landlord.
