What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
Since the Tenants paid all of the rent owing for the period ending August 31, 2020, it is not unfair to deny the Landlord's application to terminate the tenancy for non-payment of rent. The Tenants shall, however, be required to pay the Landlord's Board filing fee of $175.00.
