What happened
Tenant applied for an order determining that the Landlord had collected or retained money from the Tenant contrary to the requirements of the Residential Tenancies Act. The Tenant asserted that the rent charged by the Landlord is illegal as they did not receive a notice of rent increase and the rate of increase charged exceeds the guideline amount.
The ruling
The Landlord is ordered to pay the Tenant $3,642.80 in excess rent collected, $174.98 in interest on the last month's rent deposit, and $58.00 for the cost of filing the application, for a total of $3,875.78. If the Landlord does not pay the full amount by November 30, 2021, the Landlord will owe interest at 2% annually on the outstanding balance.
