What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice) and a Notice to End your Tenancy at the End of the Term (N8 Notice), which the tenants did not void by paying the arrears. The second Tenant Kurriah Cruz had vacated the rental unit on April 6, 2024, prior to the hearing date, but the first Tenant Kortnee Cruz was still in possession of the rental unit.
The ruling
The tenancy is terminated effective April 29, 2024 unless the Tenant pays $20,826 to void the order and continue the tenancy. If the Tenant does not pay, they must vacate the unit by April 29, 2024 and pay the Landlord $15,068.97 plus daily compensation of $84.82 per day starting April 9, 2024 until the unit is vacated.
