What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant paid $2,210 after the application was filed, but still owed $91.18 for the period ending August 31, 2018. The Tenant claimed she was entitled to recover $140 for lost wages, $350 for illegal use of her parking space, and $284.28 for hotel expenses while the floors in her unit were being repaired.
The ruling
The Tenant is ordered to pay the Landlord $91.18 in rent arrears and the $190 application filing fee, less the $284.28 rent abatement for hotel expenses. The Tenant has a credit balance of $3.10 which can be offset against future rent owed. Relief from eviction is granted due to the relatively small amount of arrears and the offsetting abatement.
