What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant challenged the rent arrears calculation and claimed the Landlord substantially interfered with his reasonable enjoyment of the rental unit by not providing adequate internet service.

The ruling

The tenancy terminated on February 1, 2020 when the Tenant vacated the rental unit. The Tenant is ordered to pay the Landlord $1,175, which includes rent arrears and the application fee, minus a $60 abatement for the Landlord's substantial interference with the Tenant's enjoyment of the rental unit. The Tenant is permitted to pay $100 per month until the balance is paid, with the final $75 due by March 15, 2022. If the Tenant fails to comply, the Tenant will owe interest at 2% annually on the outstanding balance.
