What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenant did not void the notices by paying the arrears. The Tenant had vacated the rental unit prior to the hearing date.

The ruling

The tenancy is terminated effective April 30, 2021. The Tenant must pay the Landlord $17,171.05, which includes rent arrears up to the termination date, compensation for use of the unit after termination, and the application filing fee, less the rent deposit and interest owed on the deposit. If the Tenant does not pay the full amount by April 30, 2021, the Tenant will owe interest at 2% annually on the outstanding balance starting May 1, 2021. The Landlord's request for expedited enforcement is denied.
