What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The tenancy is terminated effective January 31, 2022, and the Tenant must vacate the rental unit by that date. The Tenant does not have to pay rent for November 2021, representing one month's rent compensation. If the unit is not vacated by January 31, 2022, the Tenant shall pay the Landlord $46.03 per day for compensation for the use of the unit from February 1, 2022 until the Tenant moves out.
