What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant substantially interfering with other tenant's reasonable enjoyment of the residential complex and the lawful rights, privileges and interests of the Landlord. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The tenancy is terminated effective February 17, 2023. The Tenant must move out of the rental unit on or before February 17, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. The Tenant shall pay the Landlord $585.31 for compensation for use of the unit from February 3, 2022 to October 19, 2022, less the rent deposit and interest owed on the deposit. The Tenant shall also pay the Landlord $4.57 per day for use of the unit starting October 20, 2022 until the Tenant moves out, and $790.99 for the reasonable costs of repairing the damaged stove, and $186.00 for the cost of filing the application.
