What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant has not paid the total rent the Tenant was required to pay for the period from April 1, 2020 to December 31, 2020. The Landlord served a Notice of Termination effective April 29, 2020 due to the rent arrears.

The ruling

The tenancy is terminated effective February 5, 2021. The Tenant must pay $2,108.91 to the Landlord, which includes rent arrears up to January 25, 2021 and the application filing fee, less the rent deposit and interest. The Tenant must also pay $40.16 per day in compensation starting January 26, 2021 until the unit is vacated. If the Tenant pays $3,884.69 by January 31, 2021 or $5,133.16 by February 5, 2021, the Tenant can void the eviction order and continue the tenancy.
